(hereinafter, the Owner), with Tax Identification Number (NIF) B44630325, and Registered Business Office at C/José María Salaberria 13, 7ºA, Donostia - San Sebastián, Gipuzkoa 20010, registered in the Commercial Registry of San Sebastián, Volume: 3083, Page: 116, Section: 8, Sheet: 45587, Entry: 1, is the owner of the Website accessible via the URL: https://nawturalrun.com/ (hereinafter referred to as NAW, the Website or the Owner, interchangeably).

The following are the general conditions that govern access to the Owner’s website, including the services and functionalities offered therein, without prejudice to the application of other specific conditions or subsequent amendments. We recommend reading and reviewing these conditions periodically, as legal texts may be subject to modification.
General Terms of Use
1. Legal Parties
These General Terms of Use are entered into by and between the Owner, on the one hand, and you, as the User, whether a natural or legal person, who voluntarily and freely accesses the Website. These conditions shall apply regardless of whether or not you purchase the products offered on the platform.
2. Purpose of the Website
The purpose of this Website is to promote and sell Naw sports shoes, as well as to provide information about the products and functionalities offered by the Owner. Access to and browsing on the Website is free of charge, although the offer and purchase of products requires payment of a price and acceptance of the General Terms of Purchase.
3. User Obligations
As a User, by simply accessing and browsing the Website, you shall:
a. Use the Website diligently, correctly and lawfully, always in compliance with the applicable legislation, public morals, generally accepted good practice and public order.
b. Periodically review these Conditions, or any others that may apply, to check for any amendments.
c. Review communications sent to you by NAW, as they may contain important information.
d. Not use the Website for commercial purposes, in particular for collecting information or content for the purpose of providing services that would clearly constitute competition for NAW.
e. Not modify, or attempt to modify in any way, or take actions or use means aimed at simulating the appearance or functions of the Website.
f. Not damage, disable, overload or hinder the service (or the network or networks connected to the service), or interfere with its use and enjoyment.
g. Refrain from taking any action that may result in the introduction of computer viruses, worms, trojans or any other type of malicious code intended to interrupt, destroy or limit the functionalities of the Website.
h. Not use reverse engineering techniques and/or decrypt, decompile or employ any other system intended to discover the source code of NAW.
i. In all cases, refrain from carrying out any act that may infringe the rights or interests of the Owner or third parties, such as, by way of example, intellectual or industrial property rights (patents, trademarks, copyrights, trade secrets, etc.).
4. Website Availability
The Owner seeks to improve and expand NAW, as well as its content and the services offered therein. Nevertheless, the Website shall be displayed as it exists at any given time, subject to availability, limitations and other prevailing circumstances.
5. Registration Conditions
These Registration Conditions are entered into by NAW, on the one hand, and the User who has completed the corresponding form to create an account and followed the steps indicated on the Website to register, together with acceptance of these Conditions including:
5.1. Requirements and Procedure for Creating an Account
To create an account on the Website, the User must be a natural person of legal age as provided under Spanish law.
The User must access the “Log in” option and click on “Don’t have an account? Create one here”, provide name and surname(s), enter an email address and other requested details, and secure the account with a password. All indicated steps must be completed, including reading the information relating to the Privacy Policy and these Conditions.
NAW shall confirm the User’s registration on the Website by sending a welcome message, from which point the User shall be deemed a Registered User.
If the Registered User does not remember their password, they must click on “Forgot your password?”, and enter the email address used to register, in order to reset it.
The Owner reserves the right to check and verify the User’s identity at any time. Failure to meet the requirements set forth in this section, or misrepresentation of identity, entitles the Owner to deactivate such User at any time, without incurring any liability.
5.2. Personal Information Given to NAW
Registration with NAW as a User allows storage of personal information. As a Registered User, you may also save delivery or billing address details for future purchases.
5.3. Obligations of the Registered User
The Registered User shall:
a. Not register with multiple User accounts on the Website, nor do so using false data or impersonating third parties. You are responsible for providing accurate information.
b. Not use or attempt to use another User’s account without authorisation or consent.
c. Be solely responsible for all activities carried out from your personal NAW account.
d. Safeguard the confidentiality of your access credentials, as you will be liable for any damage suffered by yourself or third parties as a result of a breach of these Conditions. You are also responsible for what occurs in your personal account, unless its security has been compromised for reasons beyond your control. Specifically, you must:
i. Keep the account details up to date.
ii. Store the chosen password confidentially.
iii. Be the sole User of the created account.
iv. Not sell, transfer or otherwise assign the account to any third party.
e. NAW reserves the right to verify the User’s profile and may delete or suspend the account in case of breach of these legal texts or any other applicable conditions.
5.4. Modification of the User Account
At any time, the Registered User may modify personal data, delivery or billing addresses within the “My Profile” section.
6. Liability Exclusion
NAW endeavours to ensure the Website’s services and functionalities remain available at all times. However, when you access it, it will be displayed according to availability and prevailing limitations.
Despite the Owner’s continuous efforts to protect the systems and content included on the Website, employing standard Internet security measures, it is not possible to guarantee complete protection against intrusions or loss of information. Likewise, it cannot be guaranteed that the Website or third-party sites are free from viruses or other harmful elements that may cause alterations in the User’s computer systems, whether software or hardware. For this reason, the User acknowledges and accepts that certain situations may be beyond NAW’s control.
The Website may include links to third-party websites or pages external to the Owner, for which the Owner assumes no liability, having neither approved nor reviewed their functions and content. Accessing any link published on the Website is undertaken at the User’s own risk, without the Owner assuming any responsibility.
Similarly, the Website is exempt from any liability arising from misuse by Users, as well as for breach of obligations or commitments assumed under these conditions or any others applicable.
7. Intellectual and Industrial Property Rights
All intellectual and industrial property rights over the Website and its content, including programming, design, applications, graphics, codes, text, images, trademarks, trade names, distinctive signs, industrial designs, utility models and other elements, belong exclusively to the Owner or are used under sufficient rights and/or authorisations.
Likewise, any intellectual or industrial property rights derived from the products or services are the exclusive property of NATURAL ACTIVE WEAR S.L. Furthermore, the purchase of any product shall not be construed as an assignment, transfer or licence to exploit the related industrial or intellectual property rights, including but not limited to rights over industrial designs, utility models, patents, trade secrets and any other tangible or intangible rights related to the products and/or services, unless expressly stated otherwise.
As a result, any reproduction, distribution, public communication (including making available), transformation or any other form of exploitation, even with reference to the source, is prohibited without the prior, express and written consent of the Owner or the exclusive rights holder concerned.
If you detect any infringement of intellectual or industrial property rights on the Website, we kindly ask that you notify us promptly by writing to the email address indicated above.
8. Indemnification
The Owner may sanction any User who breaches applicable conditions with temporary or permanent denial of access to the Website. The duration of such sanction will depend on the type of infringement committed. Denial of access shall not entitle the User to any compensation.
Any damage, harm, loss or cost (including legal fees and/or solicitor’s costs) resulting from a breach by the User of these Conditions, or any other applicable terms, incurred by NAW must be compensated by the User responsible. This includes any third-party claims arising from such breaches.
9. Amendments
These Conditions may be amended and/or updated at any time without prior notice. Amendments shall take effect upon their publication on the Website, regardless of the medium or format employed.
Amendments shall only affect Users who accepted them after such amendment.
10. Miscellaneous
10.1. Severability and Interpretation
If any provision is declared illegal, invalid or unenforceable by the competent authority, such provision shall be interpreted in the manner most closely reflecting its original intent. In any case, such declaration regarding any provision shall not prejudice the validity of the remaining provisions.
Failure by the Owner to demand strict compliance with any of the terms herein shall not constitute, nor be construed as, a waiver of the right to enforce them in the future.
10.2. Language
The applicable language of these Conditions is Spanish. If versions in other languages, such as this version in English, are provided, these are solely for courtesy and convenience for the User. In case of contradiction, the Spanish version shall prevail.
10.3. Governing Law and Jurisdiction
The relationship between the Owner and the User shall be governed by Spanish law. Disputes or conflicts arising under these Conditions shall depend on whether the User qualifies as a consumer and/or user under the applicable legislation.
If the User is a consumer and/or user, disputes shall be submitted to the Courts and Tribunals of the User’s domicile. In cases where the User does not have such status, disputes shall be subject to the Courts and Tribunals of San Sebastián.
